End-of-service in Saudi Arabia isn’t just an offboarding formality. It’s a legally mandated financial settlement, and getting it wrong exposes your organisation to GOSI penalties, Ministry of Human Resources audits, and employee disputes that drag on for months.

Most HR teams handle this reactively. They chase payroll figures at the last minute, miscalculate the gratuity entitlement under Article 84 of the Saudi Labour Law, and issue letters that don’t align with GOSI’s contribution records. The result is rejected clearances, delayed final settlements, and frustrated employees who know exactly what they’re owed.

A correctly structured GOSI settlement letter serves two purposes: it documents the employer’s compliance with social insurance obligations and confirms the end-of-service gratuity amount the employee is entitled to receive. Both figures must match. If they don’t, the clearance stalls.

This guide gives you a free copy-paste letter template, the MENA gratuity calculator so you can verify the figure yourself, and a step-by-step breakdown of every field that needs to appear in the letter.

Let’s dig deeper into how to issue this correctly and avoid the most common compliance gaps.

A GOSI settlement letter is an official document issued by an employer to a departing employee in Saudi Arabia. It confirms the employer’s General Organization for Social Insurance contributions are settled and states the employee’s total end-of-service gratuity calculated under Article 84 of the Saudi Labour Law. HR teams issue this letter as part of the final clearance process.

What is a GOSI Settlement Letter?

An image of a recruiter typing GOSI settlement letter

A GOSI settlement letter is a formal document confirming that an employer has fulfilled all General Organization for Social Insurance obligations for a departing employee. It verifies that contributions, the employer’s share (11.75% for Saudi nationals) and the employee’s share (10%) have been paid in full up to the final date of employment.

The letter also states the employee’s end-of-service gratuity entitlement under Saudi Labour Law. It functions as the employer’s signed acknowledgement that the employee leaves without outstanding financial obligations through GOSI or the Labour Law gratuity framework.

This document is separate from a standard experience letter or termination letter. It is specifically required to complete the Qiwa platform clearance and to process the employee’s GOSI subscription cancellation.

Who is Required to Issue a GOSI Settlement Letter?

An image of a recruiter typing GOSI settlement letter on laptop screen

Any employer registered with GOSI who is terminating or accepting the resignation of a Saudi national employee is required to process a GOSI settlement. This applies to private sector companies, government contractors, and commercial establishments of any size registered under Nitaqat.

For expatriate employees, GOSI contributions apply only to the occupational hazard component (2% employer contribution). The settlement process is simpler, but the end-of-service gratuity calculation still applies under Article 84 regardless of nationality. The GOSI settlement letter is most critical for Saudi national employees where both annuity and occupational hazard branches are active.

What Information Must the Letter Include?

An image of a recruiter discussing GOSI settlement

A complete GOSI settlement letter must contain all of the following. Missing even one field can result in rejection during the Qiwa clearance process or a GOSI audit query.

  • Employer name, CR number, and GOSI employer registration number
  • Employee full name as per national ID or Iqama
  • Employee national ID or Iqama number
  • GOSI subscription number assigned to the employee
  • Date of appointment and final date of service
  • Total years and months of service
  • Last basic monthly salary used for gratuity calculation
  • Total GOSI contributions paid during the employment period
  • End-of-service gratuity amount calculated under Article 84
  • Reason for termination: resignation, employer termination, retirement, or contract completion
  • Authorised signatory name, title, and company stamp

📌 The gratuity amount in the letter must match the figure processed through the Wage Protection System (WPS). Discrepancies between the letter and the WPS transfer are a common trigger for Ministry of Human Resources complaints.

How Do You Calculate End-of-Service Gratuity Under Saudi Labour Law?

An image of two recruiters discussing GOSI settlement

Article 84 of the Saudi Labour Law sets out the gratuity formula based on two variables: years of service and reason for termination. The formula uses the employee’s last basic monthly salary, not total compensation, as the base figure.

The Base Gratuity Formula

  • First 5 years of service: half a month’s salary per year
  • Each year beyond 5 years: one full month’s salary per year

Resignation Adjustments Under Article 84

  • Less than 2 years: no gratuity entitlement
  • 2 to 5 years: one third (33%) of the base gratuity
  • 5 to 10 years: two thirds (66%) of the base gratuity
  • 10 years or more: full 100% of the base gratuity

Employer-initiated terminations, retirement, and contract completion all entitle the employee to 100% of the base gratuity regardless of tenure.

Use the calculator below to generate the exact gratuity figure for your employee before you complete the settlement letter. It covers Saudi Arabia, Bahrain, Kuwait, Oman, Qatar, Iraq, and Jordan, calibrated to current official labour law formulas.

📌 Always use the employee’s basic salary, not total package including housing, transport, or other allowances, as the gratuity base, unless the employment contract explicitly states otherwise. Most GCC labour courts and tribunals default to basic salary only.

Enter the employee’s appointment date, end-of-service date, last basic monthly salary, and termination reason. The calculator handles partial years automatically and applies the correct resignation reduction percentage for Saudi Arabia and Kuwait.

How Do You Process the GOSI Settlement Through Qiwa?

The GOSI settlement letter is issued in parallel with the Qiwa subscription cancellation process. Both must be completed within 30 days of the employee's final working day to avoid late contribution penalties.

Step-by-Step Process

  • Log into Qiwa using the authorised HR representative's account and navigate to the departing employee's profile.
  • Submit the end-of-service request and confirm the termination date and reason.
  • Log into the GOSI portal (gosi.gov.sa) and verify all contributions through the final month are reflected as paid.
  • If any contributions remain outstanding, settle them before proceeding to the clearance step.
  • Download the GOSI contribution statement for the employee and retain it in the HR file.
  • Calculate the gratuity amount using the formula in Section 4 above or the embedded calculator.
  • Issue the GOSI settlement letter using the template above, signed and stamped.
  • Process the gratuity payment through WPS within 30 days of the final working date.

📌 Under Article 88 of the Saudi Labour Law, delays beyond 30 days entitle the employee to compensation at the employer’s expense. Process the WPS transfer before the letter is signed and dated to document compliance.

What Mistakes Should HR Teams Avoid?

An image of a recruiter

These are the errors that consistently cause clearance rejections and Ministry of Human Resources complaints.

✗  Using total salary instead of basic salary as the gratuity base.
✗  Issuing the letter before settling outstanding GOSI contributions.
✗  Stating a gratuity figure that doesn't match the WPS payment record.
✗  Applying a resignation reduction percentage to an employer-termination case.
✗  Failing to include the GOSI subscription number on the letter.
✗  Rounding years of service without accounting for partial months.
✗  Delaying the letter beyond the 30-day window from the final working date.

FAQs

Does an expatriate employee receive a GOSI settlement letter?

Expatriate employees are not enrolled in the GOSI annuity branch. Only the occupational hazard contribution (2% employer share) applies to non-Saudi employees. The settlement process is simplified and typically does not require a formal GOSI settlement letter. However, the gratuity calculation under Article 84 applies to all employees regardless of nationality and should be documented in the final settlement paperwork.

What if the employee has unpaid leave deductions or salary advances?

Deductions for salary advances or unpaid leave are applied to the final salary payment, not to the gratuity amount itself. The Article 84 entitlement cannot be reduced by deductions except in specific circumstances defined by the Labour Court. Document any outstanding advances separately in the final settlement calculation sheet and process them through payroll rather than subtracting them from the gratuity figure stated in the letter.

Can an employer deduct from the gratuity if the employee resigns without notice?

An employer may claim compensation for a notice period not served, but this is separate from the gratuity entitlement. The gratuity figure in the settlement letter should reflect the full statutory amount. Any notice period claim must be handled separately and cannot reduce the gratuity without a written mutual agreement or Labour Court order.

Is a GOSI settlement letter the same as a service certificate?

No. A service certificate confirms employment dates and job title for professional reference purposes. A GOSI settlement letter is a compliance document confirming financial obligations have been settled. Issue them as separate documents. Combining the two creates confusion during background checks and government audits.

What if GOSI records show a different start date than the HR contract?

GOSI records the start date as the date the first contribution was submitted. If contributions began later than the contract start date, calculate the gratuity from the contract start date as per the signed employment agreement. Document the discrepancy in writing and retain the original contract to support the calculation if disputed.
